SUPREME COURT RULING ON MSME ACT

Even in the presence of an arbitration agreement between the parties, the parties shall continue to have access to the Facilitation Council as described in the MSMED act. According to the court’s rationale, the MSMED Act is a specific piece of legislation that governs medium-sized and small businesses. DELHI HIGH COURT RULES ON SARFAESI CHALLENGE
